Domestic violence is never acceptable, everyone deserves healthy relationships. Before we go any further, if you are a victim of domestic violence and need immediate help, please reach out to the National Domestic Violence Hotline www.thehotline.org. They offer confidential support and are available 24/7 by phone or chat. Our number one priority is your safety. Domestic violence can be more prevalent during many family law situations such as a pending divorce or child custody disputes. Our dedicated team provides compassionate legal service during your time of need. We will walk you through your right to petition for a domestic violence injunction, often referred to as a restraining order. The process begins when you file your petition for an injunction for protection against domestic violence with the clerk of the circuit court.
This can be filed in the county in which you currently live, even if it’s been one day, the county in which your partner or ex-spouse lives, or the county in which the domestic violence occurred. A judge will review your petition and decide on a temporary injunction lasting 15 days or less. In order to obtain a long-term injunction, you will have to have a court hearing. As a reminder if your partner or ex-spouse does not follow the court order, call the police to report the violation and ask for immediate assistance. Our attorneys are experienced in this delicate area of divorce and family law. We are here for you now, throughout the process and long after your divorce is finalized. We have the experience, resources, and skills required to provide you with empathetic and compassionate legal service.
